Chino Prison Riot Update
As of Aug. 26, 2009, here is the latest information surrounding the August 8 inmate riot at CIM's West Facility. According to CIM Public Information Officer Lt. Mark Hargrove, no inmate deaths resulted from the riot that involved hundreds of inmates. Initially, 50 inmates were transported to local medical facilities and 150 were treated at CIM. Currently, only one inmate remains hospitalized and is believed to be in stable condition...

INMATES FINALLY SHARE THE PAIN: ELIMINATION OF THE “THIRD DAY OF VISITING”
On August 17, 2009, CDCR noticed CCPOA that effective July 2009 the CDCR eliminated the Third Day of Visiting at 20 adult institutions. The reason cited for the change is the state's ongoing fiscal crisis and the mandate to reduce expenditures. The program elimination will result in the loss of a total of 79.6 Personnel Years (PYs). Staff in the positions associated with the PYs will remain in the existing assignments and be temporarily reassigned one day a week, until August 30. CCPOA is in the process of arranging for dates to meet and negotiate the impact to BU6, and the reassignment of effected staff. Attached is a chart indicating the number of positions identified per institution.

NEW LAYOFF NOTICES
On August 21, CCPOA received a notice from the Department of Personnel Administration informing us that they would be sending out approximately 1200 Surplus Notices to BU6 DJJ staff. Although all CDCR staff received a memo dated August 24, titled "Layoff/State Restriction of Appointment Notice Update," the notice sent to CCPOA did not include any CDCR Adult institutional staff. DPA generally sends out three times as many Surplus Notices as positions it intends to abolish. Further, the numbers may fluctuate with the number of vacancies, adjustments to the ward populations, staff retirements, etc. According to the notice, any layoffs would be effective December 31, 2009. Final layoff notices have to be sent at least 30 days prior to that date. CCPOA will soon be meeting with the state and will do everything it can to mitigate the impact of the "downsizing of the DJJ."

AB-14 Update
In a memo to the State Board, CCPOA Executive Vice President Chuck Alexander said: "This afternoon, the Senate voted to pass Assembly Bill 14 (see link below) related to the CDCR changes that have been in the news of late. The vote in the Senate was 21-19 with no Republican support. This Bill now goes to the Assembly for their action..."

Rural Health Care Equity Program
The $14.6 million General Fund reduction reflects the elimination of the Rural Health Care Equity Program effective August 1, 2009. This program provided a payment to employees who live in rural areas to cover higher health care cost due to the lack of managed care providers in many rural areas of the state...

Federal Court Ruling
In a letter from Chuck Alexander to the State Board: "Today, at 1400 hours, the Federal Court issued its ruling from the three judge panel regarding CDCR overcrowding and Constitutional issues associated with same. (See attached) The ruling is rather lengthy and is currently being reviewed by the legal team at CB&M who were our counsel of record on the case. Preliminary, it appears as though the order is for a population cap of 137.5% to be reached within two years. The State has 45 days to submit their plan to the Court. Again, this is just a preliminary assessment, and we will advise you further after CB&M has completed their analysis..."
