CCPOA Weekly Update - May 11, 2012

In case you missed it, the Sacramento Bee reported this week that “state workers’ compensation is back on the budget chopping block.” Administration officials who spoke anonymously anticipated that the May Budget Revise would contain cuts to payroll costs ranging from 5-10% — depending on the article you read. The rationale — and this part is true — is that the state’s budget deficit has grown since the initial budget was proposed in January, and additional cuts have to be made somewhere. It’s that second part where we have problems —since we’ve already taken a reduction, and know that there are other places they should be looking to make cuts that don’t involve our members. Any reductions MUST be shared across the board — that’s our message and we’re delivering it loudly and clearly as our discussions with the state continue. And I’m sure they’ll heat up even more after the May Revise is released next week, so stay tuned. In the meantime, you can read the Sacramento Bee articles online at www.sacbee.com...

This week weʼre also participating in DJJ use-of-force negotiations, and are preparing for both the upcoming Evidence Based Criminal Justice Training featuring Dr. Ed Latessa from the University of Cincinnati, and the governorʼs May Budget Revise, which will give us a clearer picture of CDCRʼs funding...

We are trying to secure the date of May 8 for the statewide SO6 DJJ use-of-force table, and will confirm this date as soon as it’s set.
In addition, we are trying to set dates for discussions with the state on a variety of other supervisory issues, including, but not limited to, seniority assignment re-bids and redirects.
We also recently received the SO6 statewide seniority scores by county. Each of you should also have received your personal seniority scores in the mail, along with a form allowing you to challenge your score if you believe it to be incorrect. We strongly encourage any member that believes his or her score is wrong to appeal it immediately...

Late last week the AB 109 CCPOA bargaining team reached an agreement with the state regarding post and bid. This agreement covers key aspects of post and bid as it relates to the ongoing realignment. In fact, some of the same issues pertinent to supervisors under the Seniority Assignment (SA) Agreement are being faced by the rank-and-file. Therefore, CCPOA has requested a meeting with DPA and CDCR Labor Relations to discuss a similar agreement on the key aspects that our SO6 members are facing. That meeting has been scheduled for April 2, 2012...

The Executive Council has spent the entire week in PAC meetings preparing for the upcoming Primary Election — most specifically, conducting candidate interviews. However, I also dealt with an issue at CCWF where a Lt. was being told that heʼd have to transfer to VSPW. And we received the following response from CDCR labor relations regarding the issues discussed at our follow up meeting:
Concept of Super Seniority into the SA Policy.;
CDCR does not object to the concept of Super Seniority for Supervisors. Further discussion on the implementation process is needed...

Important reminder to the membership regarding Personal Development Days (PDD):
All Rank and File members are reminded that effective January 1, 2012 you received four Personal Development Days (PDD), two for 2011 and two for 2012, in accordance with the Memorandum of Understanding (MOU). These days must be utilized during the calendar as they have no cash value. If they are not used by December 31, 2012 these days will be deleted from your books. Moving forward you will receive two days each calendar year, in January. As for our Supervisory members the PDD days are in accordance with the Governors Executive order S-15-10. These two days are granted by fiscal year and must be utilized by July 1, 2012 or they also will be deleted from your books...

On Monday evening we received more details regarding the impacts of AB 109— specifically, a list of the supervisory members whoʼve been mailed Option Worksheets by the state (a total of approximately 110 S06/M06 statewide). These worksheets must be returned by today January 13, 2012. In addition, we were scheduled to meet with the State on Thursday, January 12 to discuss supervisory seniority, as well as a myriad of other important issues. The state cancelled at the last minute, stating their decision makers were not available as the reason for cancellation. We are attempting to secure another date for this meeting. So hang in there, and stay tuned...

Dear Mr. Cate:
This letter is written on behalf of all the men and women that work for you in the California Department of Corrections and Rehabilitations that are represented by Bargaining Unit 6.
In opening, we feel compelled to refresh your memory regarding the furloughing of Unit 6 members. On or about December 19, 2008, the Governor issued Executive Order S-16-08 directing State agencies to furlough employees for two days per month. On or about July 9, 2009 the Governor added a third furlough day via Executive Order S-13-09. These Executive Orders contained "limited" exemptions but also specifically exempted those who provide "service and functions of state government directly related to the preservation and protectionof human life and safety."

CCPOA’s Reply to Opposition to Request for Injunction Relief
CCPOA replies to the Opposition to Request for Injuctive Relief. CCPOA's demand for a resumption of bargaining is an issue of first impression under the Dills Act; however, "construing and applying the duty to bargain... [is a] task lying at the heart of the Board's function."
Request for Injunctive Relief
On March 11, 2008, CCPOA filed this REQUEST FOR INJUNCTIVE RELIEF with the Public Employment Relations Board. The complaint is basically an allegation that the State is in violation of the law by their refusal to return to the negotiations table with CCPOA for the purpose of negotiating an MOU. This is predicated on a "change in circumstance" that CCPOA believes has taken place since the LBFO was implemented that mandates a return to bargaining. Our complaint points out several substantial changes since the imposition of the LBFO including:
- DPA's failure to secure Legislative approval for the LBFO
- The Governor's declaration of a fiscal state of emergency, and
- The PERB's issuance of a complaint regarding the duration of the LBFO.
Apprenticeship Program DIR Letter
Dear Directory Duncan:
I am writing to you in your capacity as the Administrator of Apprenticeship. As you know, the CCPOA has filed a complaint with your office against the Division of Apprenticeship Standards and the California Department of Corrections and Rehabilitation regarding the CDCR Apprenticeship Program. You have appointed Vanessa Holton to act as the hearing officer with regard to CCPOA's complaing. This matter is not moving forward at a reasonable pace, and I am requesting your assistance in seeing that the legal issues pertainint to CCPOA's complaing get resolved quickly.
DPA sends CCPOA their LBF implementation plan
On Sept. 18, 2007 DPA sends to CCPOA their LBF implementation plan. Accordingly over 40 sections of the MOU that were never even discussed previously are now eliminated. The State's initial 6 issues have now grown to over 40 issues. [DPA Memo & CCPOA Response]

While Sacramento police and firefighters are receiving accolades from local officials for making contract concessions during tough times, our governor has summarily rejected any and all attempts by California correctional peace officers to do the same.
With California now reduced to passing out IOUs to cover its growing debts and its credit rating in free fall, the governor's refusal to even consider, let alone enact, any of these cost-saving proposals is puzzling.
We recently offered to reduce future pension obligations, alter sick leave provisions and make other contractual changes that would save California taxpayers more than a billion dollars annually, all of which were flatly rejected by the Schwarzenegger administration.
Cut the Fat Not The Muscle
While California's inmate population has grown by less than six percent since 2002, the Department of Corrections' administrative bureaucracy has doubled. Billions of dollars could be saved by streamlining operations, reducing bureaucratic staff and eliminating waste and inefficiency - without jeopardizing public safety or increasing the dangers for prison officers and parole agents.
