SB 1110 –Cedillo (D) State Bargaining Unit 6 Memorandum of Understanding (Chapter 217) Amendment – Budget trailer bill 2003 AB 513 – Matthews (D) Judicial Council will adopt a rule of court to establish procedure (Chapter 353) for jury service that gives peace officers scheduling accommodations when needed. 2002 SB 65 – Burton (D) The Memorandum of Understanding for Bargaining Unit 6 is (Chapter 1) ratified by action of the legislature on this measure. This monumental contract is for 5 years; utilizes a salary formula driven by the "Big 5" urban police jurisdictions (LAPD, LASO, SFPD, Oakland and Dan Diego PD) creates the 3.0% at age 50 PERS retirement formula (effective 1-1-06) reduces institutional vacancy plans from 12% to 5% over next several budget cycles and provides legal protections for actions of officers in the "course and scope" of their duties. 2001 SB 181 – Dunn (D) A technical clean up of SB 1910 last year addressed the problem of (Chapter 797) salary compaction for correctional supervisors. This extends coverage to supervisors under the Department of Mental Health working in CDC facilities. SB 215 – Burton (D) A technical clean up for the Peace Officer Memorial Foundation (Chapter 274) and satisfies the process needed for collected funds via the State Franchise Tax Board and State Controller to release those funds to an appropriate state agency. SB 890 – McPherson (R) Codifies current peace officer status for correctional counselors. (Chapter 119) SB 1222 – Romero (D) Equalized the "presumptions" among various peace officers at the (Chapter 835) state and local level ascribed to specific job related illnesses. Adds pneumonia, meningitis and tuberculosis. 2000 AB 649 – Machado (D) Appropriated $14 million for retroactive implementation to July 1, (Chapter 402) 1999 of new Rural Health Care Equity Program, providing up to $1,500 annual reimbursement to employees in hard to service rural areas. AB 1449 – Florez (D) Gassing assault coverage extended to CYA officers per AB 995 (Chapter 627) (1997) "Sunset" provision eliminated making law permanent. AB 1999 – Dickerson (R) Camps and minimum support facilities given priority for level 1 (Chapter 709) inmates. Anticipated result to expand camps and divert sources of contracting out "clientele" to "privateers." SB 32 – Peace (D) Workers Compensation process given an on the job "Hepatitis (Chapter 490) presumption" for peace officers who contract any strain of the disease. SB 577 – Peace (D) Training: Mandates the 16 week basic academy for CDC and (Chapter 987) CYA, plus requires a 2-week minimum additional training for supervisors. SB 683 – Perata (D) Employer-employee relations is clarified in event of an expired (Chapter 879) contract and protracted negotiations. Maintains fair share, arbitration and "no strike" by law during "good faith" talks and a procedure for implementation of last, best final offer upon impasse. SB 1910 – Dunn (D) Supervisory compaction is addressed for CDC/CYA only. $50 net (Chapter 902) pay increase effective 4/30/01, equalizing PERS (3.0% at 55) contribution and study of "total compensation" options by DPA due 3/31/01 for budget consideration. SB 2175 - Burton (D) Peace Officer Memorial Foundation assured 5 more years of (Chapter 854) funding using state income tax form "check-off" for optional contributions by taxpayers. 1999 SB 615 - Burton (D) State Employees: Memorandum of Understanding for Unit 6 - (Chapter 778) Permits increase to 90% retirement cap for line officers and supervisors. SB 400 - Ortiz (D) PERS retirement system benefit - 3.0% at 55 for peace (Chapter 555) officer/firefighter formula. One time COLA for all retirees on sliding scale, 1% to 6%. SB 514 - Chesbro (D) Health care coverage for certain rural areas: PERS - 5 year subsidy (Chapter 743) to reimburse employees up to $1500/yr for out of pocket expenses, including retirees in areas where there is no HMO coverage. SB 1230 - Burton (D) State income taxes - voluntary check-off for Peace Officer (Chapter 215) Memorial Foundation purposes. Effective 1999 tax year. AB 743 - Keeley (D) Supervisors parity bill. Gives supervisors "economic equivalent" (Chapter 792) as unit 6 package negotiated by CCPOA. AB 1222 - Kuehl (D) Corrections - prohibits out of state inmates from coming into (Chapter 707) private prisons in California. 1998 SB 615 - Burton (D) State Employees: Memorandum of Understanding for Unit 6 – (Chapter 21) Expired June 30, 1998. Topics: New PERS "defined contribution" benefit, education incentive. AB 2472 - Leonard (R) State Employees: Memorandum of Understanding for Unit 6 – (Chapter 820) Expires June 30, 1999. 5% guard pay, 5% with 42 hour "straight time", 2% for PERS "defined contribution" plan. AB 271 - Villaraigosa (D) Correctional peace officers standards and training. Requires newly (Chapter 762) funded CPOST to create recommendations for training academy by 9/1/99. Creates new internal affairs policies in CDC and CYA. Specifies wardens audits every 4 years to include personnel, security, financial and training issues. 1997 AB 995 - Pacheco (R) Assault: gassing. Defines as "aggravated battery". Carries 2, 3, or (Chapter 1051) 4 year sentence. Requires wardens or superintendents to refer case to local DA for prosecution. Tests ordered of inmates to be provided immediately to affected officer. 1996 AB 521 - Aguiar (R) Creates Tuberculosis presumption for CPOs for workers comp (Chapter 802) benefits. Was carried primarily by AB 2225 (Bowler). AB 3378 - V. Brown (D) Limits ordered AIDS test appeals by inmates to 30 days. (Chapter 1107) SB 1221 - Calderon (D) Repeal of inmate rights to visitation. Statutory change permits (Chapter 132) more control over visitation process. 1995 SB 215 - Leonard (R) Makes explicit the Director's authority to prohibit restoration of (Chapter 557) forfeited good/work time credits. 1994 AB 2163 - Areias (D) Mandates audit of Early Intervention (work comp) program. (Chapter 1034) SB 826 -Leonard(R) Authorizes BPT to extend up to 5 years parole consideration (Chapter 560) hearings for murderers. SB 846 - Presley (D) SPB Disciplinary Action Review Process improvements. Sets up (Chapter 814) statewide billing procedure. SB 1260 - Presley (D) Inmate rights reduction measure. SB 1902 - Peace (D) Establishes the correctional peace officers standards and training (Chapter 826) commission (CPOST). 1993 AB 1692 - Margolin (D) State pilot authorized to integrate regular health plan coverage of (Chapter 807) (traditionally separate) work comp covered injuries. SB 910 - Calderon (D) Clean up measure to strengthen TB testing (AB 3467) to create (Chapter 932) penalties to inmates who refuse cooperation. Scope of bill broadened to cover employees of other departments assigned to a CDC/CYA facility. 1992 AB 1435 - Elder (D) Ratified CCPOA's 1992-95 contract (Memorandum of Understanding) with the state. AB 2283 - Elder (D) Permits Unit 6, including supervisors, to opt to contribute additional savings into PERS investments funds. Also creates an individual account for each member to augment retirement. AB 3442 - Nolan (R) Clarifies Director's authority to fire any warden at will in CDC. (Chapter 1279) AB 3467 - Felando (R) Creates mandatory tuberculosis testing for inmates and a (Chapter ) negotiable staff process. AB 3603 - Umberg (D) Enhances peace officer authority for CDC, CYA field parole agents. SB 1509 – Leonard (R) Prohibits inmates, found guilty of disciplinary offense, from earning "good time" while in SHU or admin seg unit. SB 2008 - Calderon (D) Requires arsonists to register with local authorities upon release or parole from CDC, CYA. 1991 AB 904 - Elder(D) Provides specific protection for CCPOA sponsored health plan, from removal by PERS, except for failure to meet minimum criteria. AB 1790 - Elder (D) Mandates completion of state retirement on a disability case, in 90 days once file is complete. 1990 AB 3905 - Quackenbush (R) Off-duty access to state firing ranges. SB 2465 - C. Green (D) Improves retirement via "final year" compensation, extends rural health care subsidy for 3 years beginning 1991. 1989 SB 16 - Lockyer (D) Protects CPO addresses from unauthorized access via the registrar of voters. SB 76 - Ayala(D) Authorizes CDC to redirect/absorb costs to fully staff AIDS treatment unit at Chino. SB 1093 - Presley (D) Requires PERS to join with California Housing Finance Authority to produce affordable housing in rural prison communities. SB 1215 - Lockyer (D) Enhances penalties for assault on a CPO in the CYA. SB 1264 - C. Green (D) Provides 90% payment of health premium in areas where HMOs are not available and only a fee for service plan exists. SB 1550 - Leonard (R) Carries forward full finding for contract provisions and pay parity over next 3 years. SCA 1 - Garamendi (D) (Co-sponsored) Adjusts state spending limit and Prop 98, (Res. Chapter 66) authorizing greater spending subject to existing revenues. 1988 AB 24 - Elder (D) Requires CDC/CYA to provide CPOs with prescribed side handle batons and training. AB 3068 - Bader (R) Authorizes parole agents from the YOPB to carry firearms on and off duty. AB 4058 - Isenberg (D) Establishes early intervention program in CDC/CYA for (Chapter 1233) employees who sustain job related injuries. SB 406 - Presley (D) Guarantees MTAs peace officer status and LVN allowance at California Medical Facility Psyche Unit if Mental Health operates unit. SB 1241 - Waters (D) Protects CPOs from child abuse charges in the CYA. SB 1913 - Presley (D) Requires AIDS anti-body testing of inmates who assault CPOs. 1987 AB 1835 - Stirling (R) Recognizes CCPOA Joint Apprenticeship Committee as a legal (Chapter 853) entity. AB 1889 - Elder (D) Provides income savings options of SSI contributions are mandated for CPOs by the federal government. AB 2335 - Johnston (D) Provides tax break for those who volunteer to pay for benefits over the benefit package established by the state. SB 331 - Presley (D) Mandates study to create training and certifications to enhance (Chapter 1282) status of CDC/CYA MTAs. SB 402 - Presley (D) Adds the "willful and knowing killing of a CPO" to the acts constitution first degree murder. 1986 AB 1901 - Elder (D) Establishes definition of "compensation" for retirement contribution process leading to increase in take home pay. AB 2212 - Elder (D) Allows AB 2834 to be retroactive to 1982. AB 3809 - Stirling (R) Extends concealed weapon privilege to CPO retirees for personal protection. SB 259 - Maddy (R) Applies the death penalty if a prisoner murders a CPO during an escape attempt. SB 1373 - Keene (D) Establishes advisory pay and benefits with other large peace officer employers. SB 1693 - Roberti (D) Prohibits inmates from reading materials depicting sexual assault of CPOs. 1985 AB 1199 - Elder (D) Secures stab proof vests for CPOs in the CDC and CYA. (Chapter 922) AB 2160 - Bader (D) Establishes felony status for absconding from CYA Parole. (Chapter 496) 1984 AB 1904 - Seastrand (R) Requires thorough background check by the CDC prior to hiring (Chapter 424) CPOs. AB 2834 - Seastrand (R) Establishes service credit for medical retirement pre-age 50. (Chapter 1756) AB 3361 - Elder (D) Implements 2.5 percent retirement at age 55. SB 2025 - Richardson (R) Gives Peace Officer status for Youthful Offender Parole Board Agents. 1983 AB 971 - Elder (D) Negotiated 2.5 retirement at age 55.
