Furlough Lawsuit – This past week, the California Court of Appeal issued its decision in CCPOA’s furlough case. Here are some excerpts from the memo Executive Vice President Chuck Alexander sent to the CCPOA State Board of Directors.
“The Court of Appeal followed the reasoning of the California Supreme Court in the Professional Engineers case and overturned our case which we previously won in the Alameda Superior Court. This unfortunately puts our members in the same position as all other furloughed state workers whose cases have been denied.
We obviously disagree with the court’s decision. Over the coming days we will be closely reviewing the decision and evaluating our options in light of the court’s ruling. We will provide more information as it becomes available. In the meantime the link to the court’s full decision is attached (to the front page of the website).”
Labor Update– Meet and Confer requests have been sent to CDCR in response to notices the department issued to CCPOA pursuant to various operational changes sought by CDCR. The items include:
1. Public Safety Realignment Act (AB 109) Institution Conversion – RJD – Supervisory
2. Public Safety Realignment Act (AB 109) Institution Conversion – CIM – Supervisory
3. Public Safety Realignment Act (AB 109) Institution Conversion – DVI – Supervisory
4. Division of Juvenile Parole Operations Merger with the DAPO – Supervisory
5. Conversion of One Core Unit at OH Close to a Sexual Behavior Treatment Program
6. Conversion of an ISU #2 Lieutenant position to ISU #2 Sergeant position at CIM

DJJ/DAPO Merger Statewide Agreement– CCPOA and the State have also agreed to terms concerning the merger of juvenile and adult parole operations. There are eight individual items contained within this agreement, so please go to the website to read the entire document.
CAPITOL NEWS
Cell Phone Bill Signed– Gov. Jerry Brown signed SB 26 (Padilla) yesterday, making it a crime to smuggle cell phones to inmates in state prison and for inmates to possess such devices. Gov. Brown also issued Executive Order B-11-11 which directs CDCR to increase the number of searches of persons entering its facilities and to issue “a report on the feasibility of creating “airport-style” security at all prison entrances.”

Fire Chapter Meeting– Will be held Saturday, October 15 from 9-5 at the Doubletree Hotel in Bakersfield. Please see the flyer on the CCPOA website for more details and registration information.
Camps Chapter Meeting– Will be holding their next statewide meeting on October 13, 2011 from 10am to 6 pm at CCPOA Headquarters. We have posted a flyer on the website with more details and RSVP information.
MTA Chapter Meeting– Will be held on October 22, 2011 at the Beach Resort in Monterey from 9-5 pm. Please see the flyer on the website for more details and RSVP information.
CCPOA State BOD Meeting/Memorial– Updated: The annual “Correctional Peace Officer Memorial” has been scheduled at CCPOA Headquarters for Friday, October 28 at 4:00 pm. The state Board of Directors meeting will be held the following day, Saturday the 29th at the Holiday Inn Capitol Plaza, Sacramento.
