Letter From State President on Seniority Scores– State President Mike Jimenez sent out a memo to the CCPOA State Board this week addressing a letter that is being sent to ALL CDCR employees from the CDCR Human Resources division. Here are some excerpts:
The purpose of this letter is to inform each employee of their seniority score and provide you with the opportunity to dispute any discrepancies should one exist. The letter is being sent based on the premise that staffing reductions will occur as a result of the passage of AB109, which is designed to move some LOW LEVEL offenders out of the state system and return them to local supervision. Though the letter does not mention the recent Supreme Court decision, the expected population reductions may also correlate to staffing changes.
CCPOA met with CDCR earlier this week and we will be discussing this issue with the Governor’s administration to seek further clarification on the department’s implementation plans for AB 109.
This notice is being provided to you in an effort to keep CCPOA members updated with the most current information that we have. Please don't be alarmed when you receive your Seniority Score Verification letter and there is no additional information available from your local management team.

Arbitrator Rules on 80-Cap, Order Overs – Also this week, CCPOA prevailed in an arbitration over a grievance we had filed pertaining to the 80-hour cap rule for overtime. The arbitrator held that Article XII, Section 12.05(B) of the contract controls voluntary overtime. While the 80-cap was not eliminated, the arbitrator ruled that the department must first utilize the voluntary overtime list, by seniority prior to ordering over. We’ll post more on this issue next week.
CCPOA Furlough Case Set for Hearing – CCPOA’s successful lawsuit over the Schwarzenegger administration’s furlough program has been set for oral arguments before California’s 1st District Court of Appeals on August 18. Unlike many of the other state worker lawsuits over the furloughs, CCPOA’s case is based on the “self-directed” aspect of the furloughs, which required employees to work for free with the promise of actual days off in the future. Inmate Homicide Investigation– Authorities are investigating as a homicide the death of a 25-year-old inmate at High Desert State Prison near Susanville. The inmate, who came to the prison in May to serve a sentence of 25 years-to-life for a Santa Clara County murder, was found in his cell Monday morning. His cellmate is being held in isolation while the crime is being investigated by state and local officials.
CDCR Tells Court of Delay in Population Reduction Plan– CDCR said in a court filing last week that it has the funding to reduce its prison population in compliance with a US Supreme Court order, but it anticipates it will meet the court’s first prisoner reduction benchmark a month behind schedule. The full article discussing some of the details of the plan is linked to our website. The prison realignment law goes into effect Oct. 1, giving the corrections department time to finish its fall population projection, which will include projections related to the number of inmates the law will take out of the state's prisons. In addition to moving inmates to county jails, the department plans to add about 10,000 beds and plans to move inmates to prisons in other states.
