5150 Update - July 2, 2007
Hello and thank you for calling the 5150 hotline. Today is Friday, July 2nd and this is the latest from Sacramento.

As has been widely report, that state and CCPOA were able to reach agreement on a proposed amendment to our contract this week.

Now that you have hit the ceiling and are yelling sell out! Please understand we did not open our contract and the proposed amendment only takes effect if both the Legislature and you the membership of CCPOA vote to accept the proposals within the amendment.

The State Board of Directors of CCPOA met today and after listening to a full explanation and having all of their questions answered voted overwhelmingly to recommend a yes vote on the proposed amendment.

Copies of the proposed amendment and ballots will be mailed to every member on July 9th. Ballots must be post marked no later than August 7. And for a little rumor control, if you don't vote it does not count as a yes vote. It is a ridiculous rumor, but we do love a good rumor in corrections.

Starting July 5th, members of the negotiating team and the Executive Council will be traveling to each institution and region holding meeting to discuss the specifics of the proposed amendments. Please keep your ears open for when a meeting near you is going to be held. Because not just CCPOA members listen to this hotline, we are not going to go into great detail on specific sections.

However here is what can be reported. The amendment contains language that is known as continuous appropriations this means the raise through 2006 would not be a part of the annual Legislative budget blood bath, but would be funded throughout the life of the contract. In other words this deal walks. It calls for a 5% raise July 1, 2004, a 5% raise January 1, 2005 and a minimum of 5% raise on July 1, 2005.

The proposed amendment also protects the integrity of the law enforcement methodology that ties our total compensation package to the CHP. Many members expressed frustration in 2002 because Section 1501 did not contain hard numbers. Well now we have hard numbers for the next year and the only raise subject to the CHP comparison methodology is the one on July 1, 2006.

On layoffs, the amendment contains language beneficial to members in both CYA and CDC that states there will be no layoffs within either department including a change in time base i.e. forcing a member to go from full time to PIE.

For those members affected by CYA closures that have already happened there is language that provides for monetary compensation to those who have been displaced.

For our rural members the amendment will provide some relief for the high medical insurance premiums that you are forced to pay.

There are no changes in sick leave language, investgatory rights and 7k still goes away this month and most importantly the 3.0 retirement still becomes effective January 2006.

Although not in the amendment itself, our supervisory division secured the same raises for supervisors that the rank and file will receive through July 1, 2005. Supervisors will receive an additional 2.5% on July 1, 2004 to finally resolve the walk time dispute. Our supervisory reps also got the following benefits for supervisors: post and bid and they will be able to wear the same uniform as the rank and file they supervise and their shift swap language will be the same as rank and file. There is more but again not just CCPOA members listen to this hotline.

Our supervisory team did a great job for all supervisors and they dedicate their work to long time friend and supervisor activist Sergeant Gary Garnet.

Many members ask why we were even interested in talking to the state. Well Government Code section 3517.7 basically says unless the legislature appropriates money for a section to be implemented each year then it opens the MOU for renegotiation. We explored all legal options if this were going to occur and quite frankly they were not that good. This is the reason the continuous appropriation language within the proposed amendment is so important In the end we felt we had a good enough package to send to you for your consideration.
