In contract news, on April 16, and 17, CCPOA and the Department of Personnel Administration will appear at a hearing before the Public Employees Relations Board regarding the complaint ruling issued by PERB in December of 2007. As many members will recall, it was in December that the PERB ruled that the state had gone too far in trying to implement the conditions of their Last, Best, and Final Offer to CCPOA for three years. PERB ruled that the state could only implement the terms of the LBFO for one year. It has been, and it remains the position of CCPOA that under the Ralph C. Dills Act - when PERB changed the terms of the LBFO from three years to one - it required the parties to return to the bargaining table... In contract news - CCPOA and the state continue to fight over the implementation of the Department of Personnel Administration's last, best, and final offer. As most members are aware - in September of 2007 DPA declared that the state and CCPOA were at impasse and no further negotiations would occur regarding a new contract for Unit 6 members. The state presented what they called their last, best, and final offer which contained both economic and non-economic changes to the wages, hours, and working conditions of Unit 6. The term of this last offer was for 3 years... To begin with, as the Department of Personnel Administration, or DPA, continues to implement portions of their "Last, Best and Final" offer - many members have been impacted by the changes in what were previously existing "Post and Bid" procedures. The main impact of these changes has been managements labeling of positions as either, medical or gender restricted. Today is Wednesday, November 21, 2007, and here is the latest from Sacramento: We continue to wait on the Public Employees Relations Board or PERB to rule on our outstanding Unfair Labor Practice charge against the state. Around the middle of the month PERB contacted CCPOA asking for some clarifications to our original claim. CCPOA filed an amended complaint at the beginning of this week. And, while we remain hopeful, it is important to point out that all of the members of the current PERB were appointed by the Arnold administration. So this fight may continue for some time...
